Not legal advice. This document summarizes volunteer/board research and day-to-day branding rules. Consult a trademark attorney before filing, relying on clearance opinions, or changing the legal name.

1. Purpose

This runbook keeps brand consistency and trademark awareness aligned across:

  • Public website, sponsor materials, and grant applications
  • Team-facing content (Ridge Racers NJ and future program teams)
  • Email, social media, and domain naming

Goals:

  1. Present one clear organizational identity (Apex STEM Education) separate from individual team brands.
  2. Reduce likelihood-of-confusion risk with existing marks—especially Apex Learning in education-related services.
  3. Document when to escalate to counsel and optional federal registration.
  4. Provide fallback naming if USPTO or counsel recommends changes before or after filing.

2. Official names & hierarchy

Layer Name / asset Use when
Legal entity Apex STEM Education Inc. Articles of incorporation, IRS filings, contracts, bank account, W-9, insurance certificates
Public brand Apex STEM Education Website, press, sponsor decks, social bios, verbal introduction
Domain apexstem.org Canonical URL; see domain_and_dns.md
Program team Ridge Racers NJ Competition story, car/pit branding, team social accounts
Team ↔ org line Ridge Racers NJ is a competitive STEM Racing team of Apex STEM Education. Team site footer, sponsor one-pager, Instagram/YouTube bio, event banners

Brand architecture (diagram)

Apex STEM Education Inc. ← 501(c)(3) nonprofit (legal + fundraising)
├── apexstem.org ← org website, donate, sponsor, governance
├── Program: Ridge Racers NJ ← team brand (ridgeracersnj.com cross-links)
└── Program: [Future team] ← same pattern; org name unchanged

Do not imply Ridge Racers NJ is the nonprofit. The nonprofit is Apex STEM Education; teams are programs under it.

Related entity (separate): Ridge Racers STEM Education LLC — commercial/ops only; arm’s-length from nonprofit; never substitute “LLC” for the public nonprofit brand in donor-facing copy.

3. USPTO preliminary findings (volunteer research)

Summary of informal TESS / trademark search and web review (May 2026). Not a clearance search and not legal advice.

Finding Detail
APEX + STEM combination No active federal registration found for the exact phrase “APEX STEM” or “APEX STEM EDUCATION” in relevant classes at time of search.
APEX alone Many APEX marks across classes; “Apex” is crowded but not automatically blocking.
APEX LEARNING Apex Learning Inc. holds established marks (e.g., APEX LEARNING, stylized logos) with heavy use in Class 041 (education/training services)—online curriculum, virtual school, and related ed-tech. Moderate risk if our mark is perceived as overlapping online/academic education services.
STEM Descriptive of science/technology/engineering/math education; weak or unregistrable alone; acceptable as part of a longer distinctive phrase when combined with proper differentiation.
Domain apexstem.org is distinct from apexlearning.com / apexlearning.org—helpful for confusion analysis but not a substitute for trademark clearance.

Action: Before spending on marketing at scale or filing intent-to-use applications, order a professional knockout or full clearance search and attorney opinion.

4. Likelihood of confusion — operational vs registration risk

Use this table for day-to-day decisions vs USPTO filing risk. Scores are qualitative (Low / Moderate / Elevated), not legal conclusions.

Factor Operational risk (public use) Registration risk (USPTO) Notes
Mark similarity Moderate Moderate “Apex” shared with Apex Learning; full phrase “Apex STEM Education” is longer and more distinct.
Goods / services Low–Moderate Moderate We emphasize hands-on competitive STEM Racing teams, workshops, and youth programs—not a nationwide online curriculum platform.
Channels Low Low Local/regional NJ teams, events, sponsors vs Apex Learning’s B2B/B2G digital school sales.
Trade dress / logo Low (if we avoid their look) Low Do not mimic Apex Learning color palette, typography, or “mountain peak” style branding.
Actual confusion Low (none reported yet) N/A Monitor inbound email and sponsor questions; document any “Are you Apex Learning?” incidents.
Descriptiveness of STEM N/A Moderate for weak protection “STEM” may limit exclusive rights; consider emphasizing Education or a stylized logo for registration.
Geography Low Low Regional nonprofit vs national ed-tech vendor.
Overall (pre-counsel) Low–Moderate Moderate Proceed with consistent branding and differentiation; file federally only after attorney review.

5. Differentiation from Apex Learning

Dimension Apex Learning (existing vendor) Apex STEM Education (us)
Core offering Online courses, virtual school, digital curriculum licensing In-person youth STEM Racing teams: design, build, test, compete
Customer Schools, districts, states Students, families, local sponsors, community
Delivery Software platforms, LMS, credit-bearing programs Workshops, garage/makerspace build seasons, regional/national competition travel
Brand story Academic continuity, credit recovery, AP Student enterprise, engineering portfolio, motorsport-adjacent STEM
Web presence apexlearning.com ecosystem apexstem.org; team at ridgeracersnj.com

Talking point for sponsors and press:
“Apex STEM Education is a New Jersey nonprofit supporting hands-on youth engineering teams. We are not affiliated with Apex Learning, the online curriculum company.”

Use only when confusion arises—do not lead every sentence with a disclaimer.

6. Branding do’s and don’ts

Do

  • Use the full public name on first reference: Apex STEM Education.
  • Use the legal name on contracts and IRS-related documents: Apex STEM Education Inc.
  • Pair team names with the org line: “Ridge Racers NJ — a program of Apex STEM Education.”
  • Use domain apexstem.org in print and digital (consistent with domain_and_dns.md).
  • Credit the org in team social bios: e.g. Youth STEM Racing · Program of @ApexSTEMEducation (handle TBD).
  • Keep sponsor tiers and logos under org letterhead once 501(c)(3) materials are ready.

Don’t

  • Use “Apex” alone as the organization name in sponsor decks, grants, or website headers.
  • Abbreviate to “ASE” in public-facing materials without defining the full name first.
  • Style the name like Apex Learning (similar fonts, blue/orange ed-tech palette, peak iconography).
  • Claim “Apex Learning”, “powered by Apex Learning”, or imply partnership without written agreement.
  • Register social handles or email domains that could be read as apexlearning variants.
  • Let the LLC brand replace the nonprofit in donation or grant contexts.

Tagline examples (pick one org-wide; avoid near-duplicates of Apex Learning slogans)

Tagline Best for
Hands-on youth STEM through competitive engineering. Website hero, sponsor packet
Building tomorrow’s engineers, one race at a time. Events, social
Competitive STEM Racing teams for New Jersey students. SEO, grant boilerplate
Ridge Racers NJ — competitive STEM Racing of Apex STEM Education. Team-specific (required line on team materials)

7. Fallback names (if USPTO or counsel pushes back)

If counsel advises against “Apex STEM Education” for registration or public use, consider alternatives before heavy print and IRS narrative lock-in. Evaluate each with a new clearance search.

Priority Candidate Rationale
1 Summit STEM Education Geographic/neutral peak metaphor without “Apex”; distinct from Apex Learning
2 Watchung Hills STEM Education Regional anchor; ties to primary service area
3 Competitive Youth STEM NJ Descriptive, low flash; weaker brand but clearer scope
4 Torpedo STEM Education Internal project name echo; unique but may need extra explanation for donors
5 Ridge STEM Education Links to Ridge Racers lineage without full team name in org title

Renaming checklist: Articles amendment (if incorporated), IRS name control, domain redirect plan, sponsor contract addendum, team one-line update, social handle migration.

Avoid fallback names that retain “Apex” as the lead word if counsel’s concern is confusion with Apex Learning.

8. Trademark registration guidance

Question Guidance
When to file After NJ incorporation and ideally after attorney clearance. Consider intent-to-use if already using the mark publicly.
What to file Standard character mark: APEX STEM EDUCATION; optionally a logo mark once final logo is stable.
Classes (typical) 041 — educational services, workshops, youth programs; discuss 035 (fundraising/charitable services) with counsel if needed.
Basis Use in commerce (1(a)) once public programs and materials exist; or intent-to-use (1(b)) with Statement of Use later.
Attorney Use a nonprofit or trademark attorney for clearance, filing, and USPTO office action responses. Budget roughly $1,500–$3,500+ including filing fees (varies by mark count and responses).
DIY filing Possible via USPTO TEAS; not recommended without clearance given Apex Learning’s Class 041 presence.
Maintenance Renewal and declarations of use between years 5–6 and every 10 years; monitor TESS for new “APEX” marks in 041.
State NJ does not require state trademark registration; optional for extra notice.

Parallel track: Secure domain and social handles early (operational); federal registration is legal protection and can lag public launch.

9. Email, social, and domain consistency

Align with domain_and_dns.md.

Domain & web

Asset Standard
Canonical site https://apexstem.org (no www duplicate content; 301 www → apex)
Internal docs docs.apexstem.org (org-branded; not team domain)
Team site ridgeracersnj.com — cross-link to apexstem.org; org line in footer

Email (org-facing)

Address Role
hello@apexstem.org Public contact
board@apexstem.org Governance
treasurer@apexstem.org Finance
sponsorships@apexstem.org Sponsor pipeline (migrate from team-only addresses)

Use @apexstem.org on Apex letterhead; team volunteers may keep team aliases but forward sponsor and grant inquiries to org addresses.

Social media

Platform Org account Team account
Naming Apex STEM Education (display); handle e.g. @ApexSTEMEdu or @ApexSTEMEducation Ridge Racers NJ
Bio Mission + link to apexstem.org Team tagline + “Program of Apex STEM Education” + apexstem.org link
Avatars Org logo (when finalized) Team logo; co-brand only where sponsor agreements require

Consistency rule: Any new platform → register org name first, then team; document handles in board ops notes (not passwords in repo).
